The state legislature's actions early this morning raise questions about the legality of some of the bills they passed. The House Speaker and Senate President clearly signed at least five pieces of legislation after midnight on April 16th, beyond the constitutional end of the session. Those bills are on their way to the governor's desk. Senate President David Williams says, to his knowledge, he only signed two bills after midnight and said, at that time, that a legal challenge might be necessary to determine whether that was legal. The House Clerk's office journal shows the bills were signed at 11:55 p.m. on April 15th. That's because the clock was stopped in the House Chamber. Some of the bills in question are HBs 2, 170, 204, 369 and SB 188. House Bill 2 is the bill that would give tax breaks to homeowners, builders and businesses that install energy saving windows, appliances and other efficiencies. It also includes $80 million in bonding to improve energy efficiency in state buildings, though lawmakers didn't include any money to pay the debt service on those bonds.
