Reporter's Notebook: Ivan's family

5:19 PM Tue, Jul 10, 2007 |

More details from the family of Cesar "Ivan" Aguilar-Cano

Rosa (Ivan's mother)says she did seek a passport for Ivan because she wanted him to visit his grandparents in Guatemala and be able to return to the U.S.. But, she says because Ivan's father Cesar was not with her - he was working in Florida at the time - she was unable to secure the passport. Cesar tells me he had no problem with Ivan visiting his grandparents and would have signed the papers had he been here. Both say it is ridiculous to suggest that they would have harmed their son because of this passport issue.

Both parents were in agreement that Ivan should get a passport so he could visit his grandparents. And both say there has never been an issue with the custody of Ivan.

Sr. is in Catholic Ministry at Churchill and is based at Epiphany and St. Bartholomew parishes in Louisville (region 8).

Rosa has two brothers who are U.S. citizens who would have been able to travel with Ivan.

Rosa has four surviving children, her 20 year old son who was with her today, and two daughters and a son in Guatemala.

Rosa is concerned that she will not be able to travel with her son's body to bury him in Santa Rosa, Guatemala, fearing she would not be allowed back into the U.S. She says she needs to be here to seek justice for her son.

They also confirmed today that Cesar, Rosa and Rosa's boyfriend, Samuel Hernandez have all been given polygraph tests by Metro Police.

Christopher 2X tells me that LMPD's Tim Emington and Steve Green told him on Friday that police found no deception in those lie detector tests.

Cesar is concerned that his desire to have an attorney present for his polygraph test has damaged his credibility in the community. He explained that there were papers to sign and that he wanted to know what he was signing. (so, if they aren't guilty, why get a lawyer?).

Cesar says police used questions about his immigrant status as leverage when questioning him, threatening to report him to immigration authorities if he didn't cooperate.

The family also wanted to address murmurs that they have not reacted with much emotion, or that their reaction is somehow abnormal for parents with a missing, and now murdered son. Cesar widened his eyes and told me -- we are in "shock." Both say they are grieving in their own way. Rosa says she has not slept in two days and is living on coffee.

Police confirm that they have conducted consent searches and have exercised search warrants in this investigation, but say they are not releasing details. So, we will have to until the search warrants are part of the court record.
