J'Town Shooting: One More Month?

I had a nice visit with Jeffersontown Police Chief Rick Sanders. He tells me that he hopes to forward the Rick Koenig shooting investigation to the Commonwealth's Attorney by mid-August. He also revealed a few other things we didn't know.

Foremost is the clarity Sanders offered on the key question of this entire case, where was Darren Pickerill's gun when Rick Koenig fired?

Up until now, we have only heard that Pickerill "displayed" a gun. Some reports have used the word "brandished," and other reports have assumed that he "waved" the gun.

But, Sanders says both Rick Koenig and his wife contend that Pickerill drew his weapon and "pointed it at them." That is very significant and explains Koenig's claim of self-defense.

But, how do you prove that? The most that eyewitnesses have been able to confirm is that neither Koenig nor Pickerill exited their vehicles. And, Pickerill's gun was found in the open console of his H3 Hummer, to the right of the driver's seat he was in.

That brings us to what Sanders also revealed today, (July 17).

One of his two hired experts is a blood spatter expert who is examining blood evidence to try to determine the position of the people involved, in particular, Darren Pickerill's position when he was shot and the location of his gun. It seems like that's a lot of information to deduce from blood evidence, and Sanders emphasized it MIGHT lead to some determination.

The other expert is a Medical Doctor who is diagramming entry and exit wounds on Darren Pickerill, presumably with the same central question to be answered, what was his position when he was shot?

Sanders says these two experts are conducting an investigation independent of the KY State Police Crime Lab. The state forensics laboratory was given the two guns, Sanders says, in the exact condition as they were found. The state lab also has blood evidence.

It's a case where very few of the facts are in question. But will that central question ever be determined with any degree of certainty? Was Darren Pickerill's gun in such a position that it represented a threat to the Koenigs, a threat which justifies using deadly force in self-defense?
