Latest Developments in Jeffersontown Shooting

Now that Darren Pickerill's family knows where his gun was found, they want the retired cop who shot him to be arrested.

On Sunday, June 10, the attorney for Pickerill's family had called on Jeffersontown police to release that information.

The next day, Chief Richard Sanders said that Pickerill's gun had been found in the open console between the two front seats of Pickerill's H3 Hummer. Attorney Scott Drabenstadt believes that shows that Pickerill was not a threat to Rick Koenig's life when Koenig shot him.

Koenig's attorney, Mark Miller, has not yet commented, but you can be sure he will say the location of Pickerill's gun proves nothing.

Everyone I speak with about the case has different theories;

i.e. Pickerill brandished the gun to make a point and as he was putting it away, Koenig shot him,
Pickerill was threatening Koenig with the gun and when Koenig shot him, he fell back or turned away, dropping the gun in the console,
Koenig fired out of rage and didn't even know that Pickerill had a gun. That's just a sample.

Are all plausible scenarios? This is where proof comes in. Is there enough "probable cause" to charge Koenig with something? Some people have suggested options like wanton endangerment, yet with Koenig claiming self-defense, the prosecutor would have to make a case that Koenig used unreasonable or overly dangerous methods to protect himself and his wife.

With Pickerill critically wounded and suffering from brain damage, his side of the story may never be heard. Koenig and his wife appear to be the only two witnesses to the actual shooting.

Plus, the location of both men's vehicles will be a factor. The rear of Pickerill's Hummer appears to have been partially blocking Koenig's Jeep. I would think Koenig's attorney would use that to suggest that Koenig was trapped in that moment and if he had not fired, he would have been a sitting duck for Pickerill and his gun.

Unknown is what factor, if any, the release of Koenig's personnel file will be on this case. I went through the entire file, which now includes Koenig's written responses to complaints.

In the responses included in that file, Koenig never directly responds or admits to behavior that is of great concern or angst to others. If anything, Koenig believes that he is misunderstood or misinterpreted.

The question before prosecutors and the courts, what will they infer from Koenig's actions when he shot Darren Pickerill?

Due to the fact this shooting was over road rage I think the retired officer should have been arrested and go to court and let them decide. His pears shouldn't make that decission. Thanks: J.S.

If the shooter had been any OTHER civilian (not one retired from a police force) you can bet your sweet toots that that individual would have been ARRESTED ON THE SCENE. Where is the "justice" here? There is none. A guy in critical condition and NO CHARGES filed (yet).

If you want to know more about Koening, just ask the priest at his former parish. The priest had to personally stand in the parking lot and wait for him to come in the wrong way like he did time after time after time. What did Koening do after the priest's reprimand? The answer is easy - he left (QUIT) the parish. Didn't think the same rules should apply to him.

Despite the parishiners being told time after time and time again, I guess he thought he was exempt.

I would like to know why he left Texas. Do we know?
