Children, victim's kin testify at Gianquitti's bail hearing

WARWICK -- After 2 1/2 hours of testimony this afternoon, a bail hearing for Nicholas Gianquitti, the man accused of fatally shooting Cranston firefighter Lt. James A. Pagano during the victim’s son’s birthday party, will resume tomorrow afternoon.

Pagano's father, Anthony Pagano; Pagano's sister, Jean M. Verdi; Pagano's 12-year-old nephew, and another neighborhood child were among those who testified this afternoon.

According to children's testimony today, children were playing ball in the street when a tennis ball struck Gianquitti's car and he swore at the children. The children later reported what they said happened to adults in the Pagano house, where the birthday party was happening.

Pagano left the house to confront Gianquitti, and his father, Anthony, came with him, according to testimony.

James Pagano knocked at Gianquitti's door three times, then turned to leave, according to testimony from Anthony Pagano.

A verbal profanity-laced argument ensued and James Pagano, according to the father's testimony, took a swing at Gianquitti. It was unclear today the extent of contact made.

Gianquitti stumbled back, pulled a silver handgun out and fired one shot from inside his house, according to testimony, and chased James Pagano with a gun. Gianquitti allegedly fired two more times, and at some point a shot struck Pagano.

Testimony is expected to continue tomorrow in District Court, Warwick.

Gianquitti, a six-month Providence police officer who was receiving disability, has been held without bail at the Adult Correctional Institutions in Cranston since his arrest May 18.

Gianquitti had the loaded gun ready and waiting?
Thank God he didnt kill a child. His beard is gone....did his lawyers advise him to shave it so he wouldn't look so sick? How do the lawyers sleep at night?

Regardless of the circumstances, you just don't pull a gun out and shoot someone, period, end of story. Whether or not Mr. Pagano swung a punch or not, unless Mr. Gianquitti feared for his life, which I highly doubt b/c Mr. Pagano was walking away, with his back turned. What a coward Mr. Gianquitti is, shooting a man in his back. This man is a lose cannon please don't release him and endanger other peace loving citizens. He needs to be locked up and supervised he is a menace to society.

tragedy all the way around. there's no WAY a gun should have been pulled in this case.


but i can't help but notice each and every the story is reported in the paper, it somehow "changes".

something tells me we haven't heard "all" the facts yet

A terrible tragedy that quite possibly could have been avoided. Prior reports indicated that both parties had reported incidents to the police department. It is too bad that there wasn't some mediation policy that would have required each participant to come together before an arbiter to work out an agreement. Even if an agreement was not possible, when people are given the opportunity to voice their complaint it helps defuse the accumulating anger. To say that Mr. Pagano should not have swung at Mr. Gianquitti or that Mr. Gianquitti should not have swore at the children is almost beside the point. This was an incident that was only awaiting a catalyst.

We now live in a sad, scary world. There is so much sadness to this needless tragedy. We need to remember that these children witnessed their father die at a time where families come together to enjoy a birthday party. How can his son and daughter ever overcome this heartache, along with his family and friends? NEVER. Their lives are ruined forever. And, as usual, they catch a criminal and what happens? The taxpayers will support him for the next 40 years at 40,000 a year or more. WHY?

Keep this bad role model in Jail. Not only is he cheating the system! Disable after 6 months of duty, try that in a Private company, only goverment employees get away with that. this man is clearly a bad person, strip away his disability! and get rid of the keys to cell, put him away for life!!!

Things have really changed since I was a child. People don't feel the need to teach their children respect anymore. When I was a child(not that long ago) if what we were doing pissed off the neighbor, we were told either do it somewhere else or not at all. My parents or my friends parents would never let us continue to intrude on the neighbors property if it upset them. This tragedy seems to have been caused by poor parenting. The guy had a right not to want neighborhood kids in his yard or throwing a ball into his yard, it's his yard. The parents allowed this guy to be continually annoyed. I'M NOT DEFENDING HIS ACTIONS but I don't believe the victim was innocent by any means in this situation.

well, this kinda changes everything. they made it seem like he was some lunatic who just randomly went off and shot a innocent guy for no reason, now we see the victim punched the guy first.

There shold be no bail hearing. What if he loses his temper again. Why should we walk in our own neighborhoods in fear of people with bad tempers. He is where he needs to be. He should have thought about the consequences before he shot and killed a man. As I read it, Pagano struck with his hands. He was a former police officer. He knows the rules. When someone assaults you, call the police.
A lesson for everyone: You can't go approaching people like that. You don't know what type of person they are and what they are capable of. I don't care how normal people look, people have some heavy issues that we know nothing about. Be cautious out there. We live in a dangerous world.

If Gianquitti was a loose cannon so was Pagano. Pagano went over to Gianquitti's house to fight, he entered the man's home to do him harm. Gianquitti had every right to defend himself and his home, but he didn't have the right to chase him outside and fire on him. Pagano was not an innocent victim. A beating with fists can kill just as easily as a gun shot and it's stupid to say you can only defend yourself with what you are attacked with. People should teach their children better.

Life is to short.....Neighbors should be helpful, not hurtful!
Trying to tell a child(children) not to play with friends in front of there house is wrong....but...let them know the rules..tell them to show respect..thats all you can do.....if the ball lands on the lawn, hits the car...they say there sorry, and the neighbor gives the ball back.

I have children and for years certain neighbors didn't want my children playing on my (deadend street) and they couldn't play in my back yard either...what do you do? I mean we were all children at one point....

I guess before you move into an neighborhood u need to check it out....I mean if you don't want children playing near u house.....Common sense!

Mr. Pagano, was a firefighter for many years.. a wife, 2 children....a great dad, a loving husband, a loyal son.....having a birthday party for his son........ so there was many children playing in front of the house....Mr crazy man over there should of took this in consideration...
Swearing at the children not a good thing.......
I think if he had a problem with what was going on... he should of waited and discussed this situation after the party.

Instead in rage and craziness he comes out with a gun..and shoots this wonderful man dead....in front of wife and his children...and all of his family....Where was the crazy mans wife and daughter??
Why would they let him go out there with a gun... why didn't they stop him.
What the crazy man's daughter never went outside and played ball...... was she that perfect that she never made the ball go on anyones lawn...or hit someones car...... come on.....please!

How do you think the Pagano's are dealing with all of this, knowing the Gianquitti's live next door.

I heard the MrsGianquitti, is siding in with her husband, she doesn't think he did anything wrong...omg come on! His daughter is embarassed to go to school.....why couldn't she try and stop him...
Gianquitti,was and is in the wrong....he needs to pay for what he did, we don't need him in our neighborhood..........people here r very neverous, and feel like he might explode again if he gets away for his crime.
They said he was a police officer......not even on the force for 6 months.....thank god he got hurt on the job, can you imagine him being a police officer(He gives the police a bad rep)

I say lock him up.....give the Pagano family peace of mind.......Gianquitti,took away a very caring, giving, very outstanding , and good hearted neighbor....A wonderful, brave firefighter, that we will all miss......who we all loved!
Gianquitti,took someone's life, now he needs to pay the price.

To end this..... I don't care if the ball hit the car or rolled on the lawn.....the children were playing.....Gianquitti, should of never yelled swear words and the children....( would he like for swear words yelled at his daughter)
Mr Pagano, was only going over to tell him to not swear at the children....he was leaving......Gianquitti, as I would like to call him MR COWARD with a gun.... shot in cold blood Mr pagano!( I don't care that Mr Pagano hit Gianquitti,anyways he only hit him after he threaten and swore at Mr.Pagano.

I think he should be locked up for life.....his wife and daughter can go visit him.......
The pagano's can go vist Mr Pagano, but they can't talk to him,or hug and kiss him.....they will never be able to touch him or see him......unlike
Gianquitti, they can see him,talk to him.....he is alive..!

Pagano was in the middle of a birthday party, he had children other than his own in his care, their safety should have come before his temper. By running over to Gianquitti's home he put every child at that party at risk, how can you watch children when you're engaged in a fist fight?
What kind of an example was that?
Had the outcome been different and Gianquitti died from one of Paganos blows would it have been justified because Gianquitti swore? Bottom line, Pagano should have waited until the party was over and offered Gianquitti an apology for the kids hitting his car, he should have had his kids
offer an apology as well. Why is so difficult for some parents to accept the fact that their kids may actualy be at fault. I'm not saying anyone needed to die over this, I'm saying it could have been avoided, simply.

I cannot believe the crap that I am reading.......I mean to even remotely insinuate that gunning someone down is justified because he swung his fist in anger is disgusting. I pray that I don't live next door to you!!!!! This is no joke. You people should be ashamed of yourselves for even thinking that Jim Pagano was NOT an "innocent" victim!!! Bad parenting???!!! Hello - but Gianquitti swearing at kids in front of kids is good parenting?? Not to mention the small issue about the um.....hmm..... right - the SHOOTING A MAN IN BROAD DAYLIGHT IN FRONT OF HIS FAMILY???!!! and BAIL HEARING??? This is what's wrong with the American way.......20 people watch a vicious crime take place and the court actually has to try and decide if he should get out on bail??? For all you people saying "poor Gianquitti" - I bet if YOU had to live next door to him - you wouldn't want him out on bail!
