Defense to argue Narragansetts should be acquitted

Defense lawyers are expected to take the floor today in the state's trial against seven Narragansett Indians charged with misdemeanors after a scuffle at a 2003 raid of a tribal smoke shop.

The state rested its case yesterday after testimony from a detective who handcuffed one of the defendants.

Lawyers for the defendants are expected to argue in front of Judge Susan E. McGuirl in Superior Court, Providence, that the state did not prove its case and that tribal members should be acquitted.

More than four years after the raid, and two missed trial days due to juror illness, McGuirl has set April 4 as the last day of trial, vowing to begin early and stay late if necessary.

Yeah, that's what the Defense does. If the Defense were to argue that Narragansetts should be convicted they'd be the Prosecution.

I don't see any way the Narragansetts can be convicted. So many discrepancies in the State's testimony. What happened to the Governor's order about standing down if they met with resistance.

Narragansetts must be aquitted. The State does not have a case. Too much contradictory and untrue testimony (backed up by video). Any other verdict would be ludicrous.

I can't see how they won't be convicted. They put their hands on a police officer. Under any understanding of the law, that's an assault. I can't go into Providence and push a cop without getting arrested so why should be alright for the indians to do it?

I think if I put my hands on A Rhode Island State Trooper for any reason I would be convicted of assaulting him. Do I think the Indians have gotten a bum deal, Yes, do I think they are above the law, No. There is only one decision in this case, Guilty. Do I think this is fair, No, but the law is clear, if you put your hand on a Trooper, that is considered an assault, PERIOD.
