Paint companies seek overturn of cleanup plan

PROVIDENCE -- Three former lead paint manufacturers are asking a judge to strike down a 2.4 billion dollar cleanup plan requested by the state.

If the plan stands, Sherwin-Williams Company, NL Industries, Incorporated, and Millennium Holdings LLC would have to clean up roughly 240,000 homes believed to contain toxic lead paint.

A Superior Court judge has scheduled a hearing in the case for today.

The state won a landmark lawsuit last year against the companies, which were found liable for creating a public nuisance.

But the companies say the cleanup plan has major legal problems and want it eliminated or altered. For example, the companies say they shouldn't be forced to clean up individual homes when the state presented no evidence at trial identifying which properties were contaminated.

Don't forget the hefty contribution DuPont made to Patrick Lynch's campaign fund that somehow isn't a 'bribe', Bob.

I thought Greg was kidding until I did a web search for lynch dupont campaign contribution and came up with the projo article from June 2006 in the below link. It says:


"Attorney General Patrick C. Lynch accepted $4,250 in campaign contributions from DuPont Corp. lawyers and lobbyists before and after reaching a $12-million settlement with the company in the state's lead-paint case."

and that

"In the complaint, Harsch [who filed a complaint] says Lynch accepted $2,500 from Bernard Nash, one of DuPont's lawyers, and from Nash's wife."

and finally a quote from Nash:

"Patrick Lynch is a friend of mine," he said. "I support him, and I support maybe 30 other AGs."

Yeah, I'll bet he does.

Thanks, I knew about the contributions but it seems whenever i post a comment too close to the truth it gets trashed. So I went soft purposely.

None of the $12 million even went to RI its overseen by an out of state group populated by DuPont execs. Really beyond belief that this hasn't been investigated.
