Bus driver sentenced to life plus for sexual assaults

A bus driver was sentenced today to two concurrent life sentences plus 16 years to serve for sexually assaulting three developmentally disabled passengers during his route to and from an adult rehabilitation center in South Kingstown.

A jury found Jose R. Rivera, of 12 Kent St., Pawtucket, guilty in June of two counts of first-degree and four counts of second-degree sexual assault, as well as simple assault for incidents that took place in the woods and other places along the route he drove two years ago as a RIPTA bus driver, according to the attorney general’s office.

In Washington County Superior Court today, Judge Stephen P. Nugent said Rivera had no potential for rehabilitation because he isn’t accepting responsibility, showed no remorse and is arrogant.

“The bottom line is: Society in general, and the most vulnerable in particular, need to be protected,” Nugent said.

Rivera was accused in August 2005 of assaulting three women during his route to and from the Adeline LaPlante Center, an adult rehabilitation center in Peace Dale. Police investigated after learning special-needs clients had revealed independently the driver had “touched them in private places,” according to court records.

Nugent sentenced Rivera, 48, to the two concurrent life sentences for each of the two first-degree sexual assaults.

For two of the second-degree sexual assaults, Nugent sentenced Rivera to 15 years to serve concurrently with the life sentences.

For the other two second-degree counts, Nugent sentenced Rivera to 15 years to serve, concurrently with each other but consecutive to the life sentences.

For the simple assault conviction, Nugent sentenced Rivera to serve one year consecutively after the other terms.

In all, that’s one life term plus 16 years to serve.

The women, ages 22, 37 and 39 at the time of the assaults, testified during the two-week trial.

Rivera’s sister, Laura James, said in court today that he had been railroaded. She accused the court of discriminating against Rivera because he’s a native of Puerto Rico and the victims were Caucasian. The judge rebuffed that idea.

“To say that Mr. Rivera was railroaded … is, frankly, an insult,” Nugent said. He had a fair trial, the judge said.

Rivera, too, addressed the court.

“I hope in the end , I know in the end, justice will be served,” he said.

An outrage! I know nothing about the case apart from what is reported here, however the sentence for
touching three people is double life plus!? This is not murder, which would likely return a much lesser sentence. This sentence is out of proportion with the severity of the crime. What an injustice to all of us.

Just because the penalty for murder should be greater tahn what it is in alot of cases does not mean that this penalty is too harsh. It means increase the penalty for murderers. This guy does not belong in society....forever. PERIOD. What he did was take advantage of HELPLESS woman. Now let his new friends in prison take advantage of him the same way. That's JUSTICE.

So tell me jay, what IS justice for molesting the handicapped?

The only injustice here is that which was perpetrated on the victims. You remember the victims, don't you jay? The ones who are also suffering a life sentence?

No, the outrage is that a person with responsibility took advantage of three people who could not comprehend or fend for themselves. Maybe you can be his cell mate at the ACI and let him molest you a time or two. You and I do not have any idea what those victims have to live with now. The scumbag belongs in jail for life.

Taking sexual advantage of anyone to whom your care is trusted is worse than murder. The victims cannot defend themselves or cry out for help. Not only have you violated them, but you have violated all of society. I believe the sentence is correct - and should be applied to all molesters of children and the disabled

What is outrageous is criminal huggers that demand light sentences. Instead of being outraged that he got a stiff sentence, why aren't you outraged that murderers don't get tough enough sentences????

Mr. Rivera is an example of a very perverse person. He deserves this punishment. Maybe if more perverts were punished in this manner across the country....we would have fewer cases of this kind cluttering up the courts. I say let out of jail a few of the people who have commited non violent or sexual crimes and make room for the ones like Mr Rivera.

Wow. I was shocked at this sentence. I feel uncomfortable having to defend an alleged/convicted sex offender, but is this sentence really appropriate? The reporter in this article doesn't provide many details on the trial. Was there DNA evidence? Was the cased based testimony of the three women versus the driver?

When you think about it, this guy is going to be in jail for the next 45 years, assuming a life sentence. And why is the judge penalizing him for not displaying remorse? He pleaded not guilty didn't he?

Again, for those who state that this was "worse than murder" because he preyed on developmentally disabled women. What was the evidence tying him to the assaults? Was it DNA or was it based on the testimony by individuals with mental disabilities?

I have to agree with the assertion that there may be some racial bias here. He was tried in Kent Count, and his victims were all white. Was the jury all-white?

This is a very hard thing for anyone to go through. Only thing I will say. If you didn't know him it would be easy to say he should rot in hell which would be in jail. But say if you knew him. knew what he was like, the kind of man he was and how if you knew him and know how he couldn't do this. Would you still feel the same?Its easy to past judgement when you don't know him.

Would you want your handicapped daughter being transported by this man? If he was given a light sentence, would you want him in society to abuse more people who cannot defend themselves. Rape is a crime that scars the victims forever, worse than a knife or bullet wound, the psychological affects last a life time. It is only fitting that this person spends his life in jail to think about his crime. His victims will suffer forever and he should suffer also. For a person to be convicted, it doesn't take just the word of three victims, it takes DNA evidence.

Here we have a man who sexually assualted 3 women who in all probability have the mental age of 6,7 maybe 10 at best. If this were to happen to your children at that age what would you want to happen to him? He probably thought that they would not be belived. What easy prey.. Yes he was tried in Kent County by a jury that his attorney also appoved of... If it was twelve jury members that were child molesters then he may have received what he thought would be a fair vedict.

To No Name, there was no DNA evidence. No evidence of any kind. I wonder if the victims even know what really happened. I tend to believe they are not hurting...their life is no worse, his however is destroyed. I know this man's character, not the 3 "victims" character and believe he is the victim.
Justice has not been served.

Thank you Sue and Miguel. So many people are quick to pass judgement on someone they know nothing about. Were you at the trial? I think not. Just because some reporter prints something does not mean it is the truth. There are two sides to every story. Also, to answer some questions, there was not DNA and yes, the jury was all white.
