Right now on News 4 this morning, we're waiting to see if a California judge will proceed or dismiss the nation's first cyber-bullying trial of Lori Drew of St. Charles County.
You may remember she's the 49 year old woman accused of setting up a fake MySpace account, pretending to be a teenage boy and sending cruel messages to 13 year old Megan Meier.
While Drew has pleaded not guilty to four federal charges, prosecutors say she and several accomplices violate MySpace terms of service and "fully to hurt and prey on Megan's psyche."
However defense attorneys say prosecutors failed to prove their case and that the judge should now throw out the case.
